While stands and lifts assist many working professionals with their duties, they can also lead to dangerous situations. Many people who work in these professions are injured every year when they fall from stands and lifts used for their jobs. Stand-related injuries are often incredibly serious because the falls typically occur when the lift or stand is at its highest level, many feet above the ground with no barrier to catch the worker underneath.

Injuries Caused by Falling From Heights

Stand injuries are similar to those attained from falling from heights, but these injuries may also be slightly more serious since the person involved may become caught in the lift or in the safety restraints. Most often, injuries falling from stands occur because the person involved is not using their safety restraints properly or at all or is using a broken safety restraint. There are many different types of serious injuries that can be caused by falling from a lift, a stand, or a bucket. These injuries include but are never limited to:

Head injuries or traumatic brain injuries caused by falling and landing on your head or hitting your head on an object on the way down.

Broken bones from limbs becoming stuck in the lift or safety restraint or from taking a hard fall on any part of the body.

Internal injuries caused by falling onto pavement from great heights.

Cuts, scrapes, bruises, and other lacerations caused by any part of the fall.

How to Prevent Injuries Caused By Falling From Heights

If you regularly work from heights or enjoy hobbies that involve heights, it is important for you to understand the best ways to protect yourself from serious injuries.

Always wear your safety restraint and make certain that it is in proper working order before you go up in the lift.

Wear a helmet whenever you are working from heights to provide your head with some level of protection.

Follow all of the safety guidelines for your job and ensure that you always get enough sleep so you can properly run your equipment.

More and more, we realize that while guns can provide safety, a mechanism for hunting and other hobbies, and an outlet for stress on the range, they are dangerous and even a simple mistake can lead to deadly consequences. If you are thinking about purchasing a gun to protect yourself, your children, and other family members, it’s important to have a basic rundown of the simple facts before attempting to use one at all. Not all guns are the same and therefore, some firearms will have unique safety features and requirements that you should follow on an individual basis. However, all firearms safety measures start with the same basic ideas and principles. Here are some of the most important safety principles for firearms safety to get you started:

You should always assume that every firearm you approach is loaded and handle accordingly. You may “know” that you unloaded your firearm, but you may not be correct or may have forgotten, and you should never trust another person’s word when it comes to a gun.

Just because you’re a dead shot doesn’t mean you don’t need to pay attention to the area around your target. Bullets ricochet. Some bullets completely penetrate their target. Never shoot when people are in the shooting area.

Never accept a gun that is loaded. More importantly, never accept a gun that is pointed at you or another person.

Before handling a gun, you must prove that it is safe. Proving that a firearm is safe means guaranteeing that the gun is unloaded and cannot harm anyone else.

Know your ammo. Always use the ammunition that is made for your firearm. Never attempt to modify your ammunition.

Never clean your firearm without first proving that it is safe to do so.

Do not assume that putting your firearm on safety will eliminate the possibility of a tragedy. Keep your firearm locked away, separate from your ammunition.

As many Boston vehicle accident lawyers are aware, most victims of backovers tend to be children or the elderly when playing or walking in a private driveway.

In an effort to prevent backover accidents, many automakers began installing cameras mounted to the rear of the vehicle that would allow drivers to watch for pedestrians or other objects behind the car. The backup cameras were found to have the highest potential for reducing backovers, according to studies by the National Highway Traffic Safety Administration (NHTSA).

However, the NHTSA has repeatedly put off creating a final rule that would require all U.S. vehicles to feature a backup camera. The agency states that the delay will continue based on a lack of resources.

Whether or not the backup camera rules are finalized, it is important that all drivers understand that all vehicles have a blind spot. Always back out of a parking spot or driveway slowly after you have checked the area around your vehicle first.
Whether you plan on crossing several states or staying more local, it is important to prepare your vehicle for the journey. Even if you choose to take your car to a trusted auto shop for an inspection, it can be helpful to know the basics of car maintenance to prevent Boston auto accidents.

The following tips will help ensure that your vehicle is ready to hit the road:

Tires – During the summer, your tires should be inflated near the maximum limit. Make sure you have a spare tire in case of a tire blowout. Never over-inflate your tires.

Fluids – Every vehicle runs on a number of fluids in order to function properly. Be sure to inspect your car’s transmission, gas tank, brakes, radiator, and power steering for adequate levels of the appropriate fluid.

Brakes – If the brakes squeak or stepping on the pedal feels soft, take your car to a professional as soon as possible.

Belts and Hoses – Aged or weathered belts or hoses can crack and leak fluid. Make sure each belt and hose is properly secured and free of damage.

Lights – Bright and clear headlights and blinkers will help you see and react to road conditions and other vehicles on the road. Dim or flickering lights can be hazardous.

Protect yourself and your family this summer by ensuring that your vehicle is in top shape. If you or someone you love has been injured in a vehicle accident in Massachusetts as a result of another person’s reckless actions, please contact a personal injury lawyer at the Kiley Law Group. The town’s streets and roadways are riddled with potholes which pose danger of causing auto accidents.

As a way to encourage residents to report bumps and holes on the road, the mayor is launching a pothole contest, in which all Haverhill residents who report a pothole on a city street in Haverhill will automatically be entered into a drawing where three lucky winners will receive a $25 gift card each. The gift cards are donated to the contest by local businesses.

The contest ends May 10.

The goal, according to the mayor, is to fill all reported potholes within two business days.

To report a pothole, send email to pothole@cityofhaverhill.com or call 978-374-2364.

Whenever you get behind the wheel, you are responsible for your own safety and the safety of other people on the road around you. A driver may be comfortable doing other things while driving, like talking on the phone, texting, eating, drinking, or other tasks, but it takes the driver’s attention off the road. All it takes is one second of inattention to cause a fatal distracted driving accident. Looking down at a phone or even GPS navigation can make a driver miss a green light turning to yellow and red. If there is pedestrian is in the crosswalk when that driver runs the red light or applies his or her brakes too late, it may result in a tragic accident.

What You Can Do

Any task that takes a driver’s eyes off the road, hands off the wheel, or mind off of driving is a distraction and can potentially lead to causing injury or death to someone’s child, parent, spouse, sibling, or best friend. It is important to recognize these as distractions and not do them. This will not only help you drive more safely, but you will then be in a position to avoid dangerous situations that may be caused by other drivers.

For Distracted Driving Awareness Month, the Kiley Law Group urges drivers to help keep themselves and others safe by pledging to:

1. Never text and drive;

2. Never talk on a cell phone while driving;

3. Never eat while driving, especially when involving a full meal;

4. Never turn around to have conversations with passengers;

5. Secure children and/or pets when in the car;

6. Never drive while fatigued or drowsy;

7. Never surf the Internet while driving; and

8. Never read or watch video while driving.

If there is an emergency, pull over before making or taking any phone calls or texts. Cell phones haven’t always been around. For the convenience of being able to get personal news wherever a driver is (if he or she has a cell phone), he or she can take the first highway exit or pull over and park before handling the situation.

Transportation Safety Board looked at more than 1,500 auto accidents between
2004 and 2009, and nine other wrong-way accidents that the NTSB directly
investigated. The results showed that a majority of the crashes (59%) involved
drivers with blood alcohol levels (BAC) of more than twice the legal limit of
0.08. In 10% of the crashes, drivers had BAC levels between 0.08 and 0.014.

<span style="background: white; color: #383838; font-family: "Calibri","sans-serif"; font-size: 11.0pt; mso-bidi-font-family: Arial;">Age is also a factor in wrong-way
driving. Older drivers appear to be a part of the problem, researchers said.
Drivers over 70 were overrepresented in the accidents. Senior operators driving
the wrong way caused 15% of the accidents studied, compared to 3% of the
right-way drivers they collided with.

<span style="background: white; color: #383838; font-family: "Calibri","sans-serif"; font-size: 11.0pt; mso-bidi-font-family: Arial;">Wrong way accidents involving high
speeds, like those occurring on interstates, expressways, and other high-speed
highways are especially deadly. Roughly 80% of the accidents studied involved
head-on crashes in which the vehicles closed on each other very rapidly.

<span style="background: white; color: #383838; font-family: "Calibri","sans-serif"; font-size: 11.0pt; mso-bidi-font-family: Arial;">According to the NTSB, wrong way driving
usually occurs when drivers enter an exit ramp in the wrong direction, make a
U-turn on the highway, or use an emergency turnaround through a median. Most
wrong-way collisions happen in the fast lane of the highway.

<span style="background: white; color: #383838; font-family: "Calibri","sans-serif"; font-size: 11.0pt; mso-bidi-font-family: Arial;">Since alcohol intoxication plays such a
major role in causing wrong way driving, reducing drunken driving is a big step
in reducing the number of wrong-way crashes. Until stricter laws on drunken
driving and repeat drunken-driving arrests are the norm in all states,
individual drivers need to exercise more caution when it comes to driving
before driving.

To be on the Road That IsSt. Patrick’s Day is a widely celebrated Irish holiday and people pull out all the stops to do it right with lots of green décor, Irish food, and, of course, Guinness and other alcoholic drinks. Many of you will be celebrating St. Patrick’s Day this coming Sunday, March 17, 2013, at a friend’s home, at a local pub, or by even hosting a party at your home. But the holiday is not all fun and games.

What You Might Not Know about St. Patrick’s Day

While enjoying the festivities of St. Patrick’s Day, you may not realize how dangerous the holiday could be. All it takes is for one person to drink too much, get on the road to head home, and cause a drunk driving accident. According to the National Highway Traffic Safety Administration (NHTSA), 700 people were killed across the U.S. during the St. Patrick’s Day holiday from 2006 to 2010.

Helping You Stay Safe

Impaired driving endangers not only yourself but everyone on the road. As experienced car accident attorneys, the Kiley Law Group legal team has seen firsthand the consequences of drinking and driving. In order to stay safe this St. Patrick’s Day weekend, our firm encourages you to follow these tips:

As a guest or pub patron, plan a safe way home before arriving for festivities. Either designate a sober driver or take a cab.

As a host, don’t let guests who have been drinking drive. Take their keys and arrange for a safe ride home or make sure they sober up before leaving.

Use a sober ride program. Boston has the “Be My DD” program available 24/7. A driver will take you home in your own vehicle. For more information, call (877) 823-6933 or visit http://www.bemydd.com/designated-driver.html.

Avoid driving in the late night/early morning hours before, during, and/or after St. Patrick’s Day.

If you see a potentially drunk driver on the road, stay away and call it in to your local police department.

As the saying goes, don’t drink and drive, and help your friends and family stay safe by not letting them drink and drive. Also, be cautious of others when on the road this holiday weekend. If you can do those things, you’ll not just have a fun St. Patrick’s Day but a safe one too!
The vehicles’ supplemental restraint system (SRS) circuits may short, creating an abnormal flow of electrical current, which subsequently increases the level of heat and potentially damages the circuits. As a result, the front airbags and/or seat belt pretensioners may malfunction and inadvertently deploy the airbags, increasing the risk of a car accident and/or injury.

Toyota is recalling model year 2003 – 2004 Corolla and Corolla Matrix cars, and General Motors is recalling model year 2003 – 2004 Pontiac Vibe cars.

What to Do Now

Owners of the recalled vehicles will be notified by Toyota or General Motors and dealers will install a supplemental harness including an electrical filter between the airbag control module and its wire harness at no cost. A recall notification schedule has not yet been established.

If you would like additional information regarding this recall you can call Toyota at (800) 331-4331 or Pontiac at (800) 620-7668. You can also call the NHTSA Vehicle Safety Hotline at (888) 327-4236 or visit www.safecar.gov.

What if the Defect Has Already Caused Injury?

Recalls are necessary safety measures, but they sometimes come too late to prevent all incidents of injury. If you have been injured directly as the result of an auto defect or a car accident caused by an auto defect, you may be able to hold the auto manufacturer financially responsible for medical bills, loss of income, pain and suffering, and other damages. To find out if taking legal action is the best option for your particular situation, contact Kiley Law Group today to discuss your legal rights.Unknownnoreply@blogger.com0tag:blogger.com,1999:blog-3352149161615088815.post-45263163655951362652013-02-05T13:05:00.000-05:002013-02-05T13:05:12.193-05:00Truck Driver in Fatal Wellesley Bicycle Crash Sued for Wrongful DeathThe driver in the August 18-wheel truck collision with a bicycle in Wellesley, which claimed the life of a 41-year-old man, will not be criminally charged, the Boston Globe reports. According to the Globe, Wellesley Police and Norfolk County District Attorney’s Office sought indictment alleging motor vehicle homicide, but a grand jury chose not to indict.

The truck driver and his employer still face a wrongful death lawsuit on behalf of the cyclist’s family.

The accident occurred on August 24, 2012 when an 18-wheeler struck the cyclist while he was riding a bike near the intersection of Weston Road and Linden Street in Wellesley. According to police, the truck did not stop after the crash. Police found the driver two days later.

According to the trucker, he was driving the truck for his company at the time of the crash.

While the truck driver is not facing criminal charges, the victim’s family has filed a civil wrongful death suit against the driver and his company.

What is a Wrongful Death Lawsuit?

In fatal accidents where the negligent actions of a driver cause serious or fatal injuries, the victim’s family has the right to pursue a civil personal injury claim or, in the case where the victim dies from his injuries, a wrongful death lawsuit against the negligent party, seeking damages.

Depending on the causes behind the accident, the victim’s family may be entitled to financial compensation.

With so much going on in one place, it makes sense that intersections are the location of many car accidents. These accidents are not a natural consequence of an intersection, however. As Tom Kiley and the personal injury legal team at the Kiley Law Group know all too well, it is often the negligence of others that causes injury accidents and, in intersections, this negligence usually involves other drivers ignoring right-of-way rules or other traffic laws, such as speed limits. But in other cases, the intersection itself may be designed in a way that makes it more hazardous than others.

If motorists and other road users are aware of the most dangerous intersections in their state, they could exercise more caution and hopefully avoid a potentially hazardous situation, which is why the Massachusetts personal injury lawyers at the Kiley Law Group would like to pass on the following information concerning the 10 most dangerous intersections in MA, provided by GLocalProv.com:

Veterans of Foreign Wars Hwy – Varnum Avenue, Lowell, MA – 161 crashes, 42 injuries

Randolph Avenue – Chickatawbut Road, Milton, MA – 73 crashes, 40 injuries

Middlesex Street – Wood Street, Lowell, MA – 131 crashes, 25 injuries

Concord Turnpike – Cambridge Turnpike (Crosby’s Corner), Concord/Lincoln, MA – 103 crashes, 30 injuries

Pleasant Street – West Street, Brockton, MA – 90 crashes, 31 injuries

President Avenue – North Main Street, Fall River, MA – 92 crashes, 30 injuries

Plymouth Avenue – Rodman Street, Fall River, MA – 107 crashes, 27 injuries

Grand Army of the Republic Hwy – Swansea Mall Drive, Swansea, MA – 97 crashes, 27 injuries

Main Street – Pleasant Street, Woburn, MA – 121 crashes, 21 injuries

Main Street – Middle Street, Weymouth, MA – 121 crashes, 21 injuries

While being especially alert when driving through these intersections can help prevent traffic accidents, you can’t always trust that others will do the same.
The Globe reported that MetLife is working on refunding the customers that were incorrectly charged.

Defending Your Rights and Finances Against Insurance Companies

Under Massachusetts law, a driver who was penalized with a surcharge by an insurance company because he or she is deemed at-fault in an accident can appeal the insurance company’s decision to the state. If the state appeals board vacates the surcharge, the insurance company is required to halt the extra charges or refund the penalty money which it already collected from the driver.

According to the Globe, Coakley’s office will also investigate whether other Massachusetts auto insurance companies similarly violated the law.

MetLife customers who believe they have been incorrectly charged following their accident can contact the attorney general’s insurance and financial services at 1-888-830-6277.

The Taunton Gazette reports that the driver collided with a tree around 12:30 a.m. on Sunday, December 9, on Bay Street. The two passengers who were killed in the accident, a girl and a boy, were both 18 years old and from Taunton. They were both pronounced dead at an area hospital. Three other passengers and the driver were transported to another local hospital for treatment of their injuries from the accident.

The driver is continuing to recover from his injuries at the hospital and will eventually be charged by police for two counts of motor vehicle homicide by negligent operation, having an open container of alcohol in the vehicle, and operating a motor vehicle on a suspended license. Police reportedly discovered an open bottle of vodka in the vehicle.

Taunton police are not ruling out additional charges to be brought against the driver as the department’s investigation continues.

How Can You Stay Safe on the Roads This Holiday Season?

Now that the holiday season is finally upon us, many of us will be heading out for parties with friends and family. One of the most imperative reminders we can share with you is to have a plan for getting to and from your party in the safest way possible.

The National Highway Traffic Safety Administration (NHTSA) advises that if you are going to be drinking, look into other options for getting to and, most importantly, from your party. Find a designated driver who you can call, call for a cab, or take public transportation via bus or train if this option is available in the area. If you do drive to the party and find that you can’t make it home, call a taxi or a sober friend or family member to come pick you up.

Have You Been Injured in an Accident Caused by a Drunk Driver?
December is, in fact, the perfect month to focus efforts on the issue of drunk driving and general impaired driving as holiday festivities have a very large concentration of people both celebrating and driving on Massachusetts roads.

Alcohol and drugs present risks to drivers all year-round, but can be especially dangerous around the holidays. Remember, that being impaired while driving does not just involve alcohol and illegal substances, but prescription medications and even distracted driving. Any action or behavior that impairs your ability to drive safely is a hazard. Being aware of the risks of impaired driving and taking the (easy) steps to prevent it can make a significant difference in keeping everyone safe on the road.

What You Can Do to Ensure an Enjoyable and Safe Holiday Season

At the Kiley Law Group, our car accident attorneys have seen too many crashes involving impaired drivers, all of which could have been easily prevented by using one’s better judgment. The following are some important reminders to help you and your loved ones stay safe and keep others safe as well:

If you plan to drink, don’t drive, period.

Remember that “buzzed driving” is drunk driving, as the National Highway Traffic Safety Administration (NHTSA) puts it.

Do not take any medications that can impair your driving abilities.

If you are having a holiday party, don’t let people at your party drive if they have been drinking. Take their keys and arrange for a ride home.

Stay off the road as much as possible, especially as the end of the month draws closer.

Report suspected drunk drivers if you come across them while on the road.

The holidays are a time to spend time with the people you care about, and you owe it to them and to yourself to make sure you take the necessary steps to stay safe and keep others safe as well.

Cars and other vehicles behave differently under wet, icy, and snowy conditions, and so it is difficult to feel comfortable during such weather. But by taking certain precautions you can help ensure that, when you have to, you can get to point A to point B safely. As experienced car accident attorneys with the Kiley Law Group, we have seen too many accidents caused by one driver’s lack of consideration for the safety of others.

By taking the following safety precautions, you will also help keep yourself and your passengers safe from other drivers who may not be driving appropriately for the weather or road conditions:

First, if you can avoid driving in harsh weather conditions, do it. It is not worth the safety risk for that box of cookies or that cup of coffee with your friend that you see all the time anyway.

If you have to drive in bad weather or road conditions, drive as slow as you need to in order to travel safely, but be careful not to create another hazard for other drivers. There’s a difference between driving slowly to be cautious and driving so slow that you yourself are a safety hazard for other drivers.

Keep your headlights on and be vigilant of others. Always be aware of your surroundings, especially if your visibility is limited, and be on the lookout for other drivers.

Stay clear of snow plows and never pass them while they are in operation.

Don’t expect that all other drivers will be as safe or considerate as you. Keep a generous following distance.

When a Boston Car Accident Lawyer Can Help

It is unfortunate that much of the time, you are not in complete control of your own health and safety while driving. But when another person’s negligence causes an injury accident, they can be held liable in civil court. If you have been injured due to the reckless or negligent actions of another driver in Massachusetts, the Boston vehicle accident attorneys at Kiley Law Group can help you understand your legal rights and options.
According to The Eagle Tribune, a Methuen man crossing Union Street in Methuen reportedly sustained a spinal injury when he was hit by a driver this past Wednesday night around 10:00 p.m. The driver left the scene of the accident and is currently being sought by police.

Authorities reported that the 33-year-old man did not lose consciousness at the scene and was able to provide a description of the vehicle that struck him to police. It was reported that the driver proceeded down Union Street, came to a stop beyond the accident, but then fled the scene.

Officials are continuing to investigate the serious accident and are actively searching for a dark, mid-sized vehicle that could have been a delivery vehicle or a taxi. The vehicle may have damage to the front left headlight due to the impact.

The Tribune reported that as of Thursday the man was in critical condition at a Boston area hospital.

Having and using cell phones have become so second nature to
many people that they don’t even think twice about talking on the phone, or
worse, texting while they drive. The dangers of texting while driving are not new news. According to Distraction.gov, the official U.S. government website for
distracted driving, texting while driving creates a crash risk 23 times worse
than driving with your full attention on the road.

Texting takes a driver’s mind off of driving, their eyes off
the road, and their hands off the wheel. It is a recipe for disaster, but many
people believe that the statistics won’t be true for them; that if they just
read or send a quick text, nothing will happen and everything will be fine, but
this is unfortunately not the case, as is demonstrated in the following
AT&T documentary. The lives of each of these people have changed and have
even been torn apart due to texting while driving. Please be aware that some of

It is much more economical, environmentally friendly, and healthful than driving a car, but it is also much more dangerous. With the increasing incidence of distracted driving, pedestrians are at an extremely high risk of being struck, and likely killed, by a negligent driver. But there are ways both pedestrians and drivers can ensure that crossing the street does not require taking your life in your hands.

At the Kiley Law Group, our pedestrian accident attorneys have seen the damage that can be done by irresponsible drivers and hope that these tips will help prevent future accidents:

Tips for Pedestrians

Cross only at intersections, at a crosswalk, or street corners.

Where possible, always walk on the sidewalk; if there is no sidewalk, walk as far left on the street as possible, facing traffic.

Obey all traffic signals before walking into the road.

Never run into the road; always stop and check for traffic before crossing.

Watch out for turning traffic, especially on a red light.

Look both ways before crossing a street.

Make sure traffic has fully stopped before walking into the road.

Be wary of driveways, specifically the cars entering or exiting them.

Tips for Drivers

Obey all traffic signals and follow all speed limits.

Look for pedestrians at street corners and intersections even if there is no traffic signal or stop sign.

Make sure the car’s headlights are on (and working) at night.

Be very cautious near parks and in school zones.

Keep as close to the center of the road as possible when there is no sidewalk.

Always stop before sidewalks when entering or exiting driveways and look both ways for pedestrians.

Always come to a full stop at red lights and stop signs.

When a Massachusetts Car Accident Lawyer Can Help

In an ideal world, all drivers would practice caution when pedestrians are present, but this is unfortunately not how it typically works in reality. If you or a loved one has been injured in a MA pedestrian accident as the result of a driver’s negligent actions, you may be entitled to pursue legal action.
