2 Injured in 495 Rollover

Susan Earnshaw, 29, and her fiancĂ© Netaniel Nieves, 30, of Methuen sustained severe injuries in a rollover accident last Friday just before 4:30pm on I-495 in Merrimac. The Eagle Tribune reports that the couple’s Honda Civic rolled over near Exit 52 on the highway with Nieves behind the wheel, following what police are saying was a road rage incident with a second driver, who was operating a Porsche 911. The driver of the Porsche was described as having white hair and as a Caucasian male, but no further details have been reported at this time by officials.

Authorities have reported that Earnshaw was thrown from the Civic when the vehicle rolled over. She reportedly sustained severe head injuries and was in and out of consciousness when emergency responders arrived on the scene of the rollover crash. Earnshaw’s grandmother, Gertrude Earnshaw, told the Tribune that her granddaughter is currently in the intensive care unit at a Boston area hospital. There has been no further update on either Earnshaw’s or Nieves’ conditions. The accident remains under investigation by police.

Can I Trust My Auto Insurance Adjuster after a Serious Car Accident?

Los Angeles car accidents happen at a frightening rate, with an alarming amount of them resulting in catastrophic injuries. When involved in a car accident, most people immediately call their insurance adjuster. In the past, many insurance agents have expressed concern for your daily struggles, asked how your kids were doing, and in essence created a genuine relationship. Some people consider their car insurance adjuster their friend, someone who cares about them, and is there to help. Unfortunately, when you receive serious injuries from a car accident, they are no longer your friend and it quickly becomes obvious that they never were.

The sole purpose of an insurance adjuster is to make as much money possible for the insurance company. Whenever an insurance adjuster saves the company money he is passing those savings on to the shareholders. An adjuster's act of being kind is one of the many tricks they have been trained to use. When talking with an adjuster it is important to be mindful of what you say. Some adjusters will record your statements to use them against you at a later date. Their tactics in negotiation claims can be very clever.

Something that is important to keep in mind is your statute of limitations. The moment you have been involved in a California car accident the clock starts ticking towards a deadline called your statute of limitations, and this is just for a case against a third party (not a government entity). Two years may seem like a long time, but for someone who has been seriously injured it will take a year or more to fully recover from the injuries sustained in their accident. The adjuster will use this deadline as a negotiating tool, and knowing that you only have a limited amount of time left to settle could disrupt your settlement amount.

If you have been seriously injured in a car accident it would be in your best interest to consult an experienced Los Angeles car accident attorney. They will advise you of your options and help you receive fair compensation for your injuries.

Two North Shore Teens Seriously Injured in Peabody Crash

Chad Mancini, 19, of Lynn and an unidentified teenage girl, 15, of Peabody sustained serious injuries in a Tuesday morning accident on the ramp leading from Route 1 S to I-95 N in Peabody. According to The Daily Item of Lynn, Mancini reportedly lost control of his Chevy Malibu while on the ramp when he collided into a guardrail, which spun the vehicle around, causing the car to hit the guardrail a second time, before it rolled over and landed on the side of the roadway.

Both teenagers were rushed to a Boston hospital with serious injuries. Their conditions are unknown at this time. Massachusetts State Police are continuing to investigate the crash and have reported that excessive speed is most likely a contributing factor in the accident, which occurred around 7:30am. Both Mancini and the girl were reportedly not wearing their seatbelts when the crash took place. The ramp had to be shut down for purposes of the investigation and one of the lanes had reopened by 11:00am that morning.

Accidents Involving Rollovers
In a USA Today analysis report by industrial economist Joe Kimmel, sport-utility vehicles (SUVs) were found to have the highest chance of rolling over in an accident and were projected to roll over in 1 out of every 4 accidents these vehicles are involved in. Some models of SUVs are estimated to roll over in 1 out of every 2 accidents they are involved in. Passenger cars have about a 10% or less chance of rolling over in the event of a crash. Minivans were found to be very likely to roll over in an accident compared to most other passenger cars or light trucks.

Tractor Trailer Rollover on I-95 in Attleboro

A tractor trailer reportedly rolled over on the ramp from I-95 S to Route 295 earlier this morning in Attleboro. Details regarding the rollover are still coming to light but the tractor trailer crash resulted in significant back-ups for Monday morning commuters. The trailer was said to have been transporting diesel fuel, which then leaked onto the highway. The driver has not been identified yet but it was reported that he sustained minor injuries in the rollover. Emergency workers shut down the ramp from 95 to 295 in an effort to investigate the scene and clean the fuel up more efficiently.

Tractor Trailer Rollovers
Thankfully this rollover did not result in any fatalities. In the U.S. in 2009, the National Highway Traffic Safety Administration reports that nearly 9,000 vehicles were involved in rollovers where a fatality was reported. Of that total number, just over 400 of those vehicles were tractor trailers.

Update on Fatal Drunk Driving Accident at Andover State Police Barracks

Robert Bryant, 50, of Haverhill was ordered by a Salem Superior Court judge this week to undergo randomly scheduled alcohol screenings while he is free on $10,000 bail, according to The Eagle Tribune. Bryant allegedly struck and killed Cynthia Ray, 30, of Haverhill outside the Andover State Police Barracks on December 12 last year while he was under the influence of alcohol. Bryant then attempted to leave the scene of the fatal accident after hitting Ray with his pickup truck but was followed by a witness, with police following close behind. Ray had stopped by the barracks to pick up a police report for a car accident that her husband had been involved in earlier that same day.

Bryant currently faces charges of motor vehicle homicide while driving drunk, manslaughter, fleeing the scene of a personal injury accident that resulted in death and attempt to commit a crime. He could be sentenced to 15 years for the motor vehicle homicide charge if he’s convicted and 20 years for the manslaughter charge. Following the deadly pedestrian accident, Bryant’s license was automatically suspended for 6 months because he refused to submit to a Breathalyzer test. Bryant has also been ordered not to consume alcohol while on bail, in addition to completing the random alcohol tests.

Bryant is due back in court May 31 for a pre-trial hearing.
