Virginia Automobile Accident Personal Injury Claims

If you have been injured in a Virginia motor vehicle accident and are thinking about making a personal injury claim, there are few things you need to know if you hope to be compensated for your physical and emotional suffering. The Virginia automobile accident attorneys understand that the legal process can be daunting and so we’re here to help clear a few things up and make you feel comfortable and assured in your personal injury claim.

Negligence of the Other Driver
Under Virginia law, in order to successfully gain compensation for injuries that you have suffered in a car accident, you need to prove that the operator of the motor vehicle that hit you was “negligent.” This means you must prove that the other driver acted in an unreasonable manner considering the circumstances.

Often, one can prove the negligence of the other driver by demonstrating that they broke a traffic law, or other widely accepted “rules of the road.”

Some common examples of negligence include:
  • Running a red light or stop sign
  • Speeding
  • Turning in front of oncoming traffic
  • Changing lanes without using a signal

Contributory Negligence
If you are able to prove that the other driver was someway negligent in the accident, then the focus becomes your behavior behind the wheel, and whether or not you contributed in any way to the collision. If so, then your personal injury claim is over and you are entirely barred from collecting any compensation for your injuries.

This Virginia law is called contributory negligence, and while it may seem harsh, it means that even if you are 1% to blame in the cause of the accident, you get nothing. Contributory negligence is a favorite of insurance companies and is used as often as possible to make sure that you receive nothing for your claim.

Recovering Damages
If you are successful in proving both that the other driver was negligent and that you were not contributorily negligent in the accident, you can use your car accident personal injury claim to recover damages. Here are some common damages under Virginia law:
  • Lost wages (both past and future)
  • Permanent injuries
  • Medical Bills (both past and future)
  • Physical disfigurement/deformity/scarring
  • Loss of earning capacity
  • Inconvenience
  • Pain and Suffering
To ensure that you present the best possible case in court, you need to contact the Virginia automobile accident personal injury lawyers, who have the inside information garnered from once working for insurance companies ourselves. They know the personal injury claim process inside and out and will fight for your fair compensation.

Man Seriously Injured in Bourne Crash

An unidentified 22-year-old man sustained serious injuries this past Tuesday morning just after 9:00am when the sedan he was driving collided with a utility pole off of Old Plymouth Road in Bourne near Sagamore Beach. The pole was snapped in half as a result of the serious crash and the man’s car then continued into the woods on the side of the road after crashing into the pole before it came to a rest.

According to Cape Cod Today, the unnamed man was taken to an area hospital for emergency medical treatment. Authorities are continuing to investigate the cause of the accident and the young man’s condition is currently not known. Power was lost in the area of the accident for some time because of the accident.

The Centers for Disease Control and Prevention (CDC) report that car accidents are the leading cause of fatalities for those aged 5-34 across the U.S. Just over 2 million adult operators and occupants of vehicles were medically treated in emergency rooms in the U.S. in 2009 after being involved in a car accident.

Widow of Man Killed in Tunnel Crash Sues Big Dig Contractors

The widow of Brian Hicks, a 39-year-old Salem man who died in a horrific tunnel accident in Boston has filed a wrongful death lawsuit against eight Big Dig contractors.

Hicks’ accident occurred on March 27 in a connector tunnel between the Sumner Tunnel and Storrow Drive in Boston. Hicks had lost control of his pickup truck when he struck a Jersey barrier inside the tunnel, and was ejected from the vehicle.
He became entangled in the razor-sharp handrails, which contributed to his death.
Hicks, a married father of one, is the eighth person to die on what some have dubbed the "Ginsu guardrails," news reports said.

Details of the Wrongful Death Lawsuit

His widow, Donna, is suing the contractors over the design of the handrails. She filed a wrongful death lawsuit on Monday in Suffolk Superior Court, alleging that the eight Big Dig contractors knew the design of the railings was inherently dangerous but have failed to take any action to address the problem despite the deaths.

The lawsuit seeks just under $2 million in actual damages plus additional damages to be determined by a jury.

The names of the Big Dig contractors named in the lawsuit are:

  • Bechtel Corp.,
  • Parsons Brinckerhoff Americas,
  • Bechtel/Parsons Brinckerhoff,
  • GMT Architects Inc.,
  • Tuttle Aluminum and Bronze Inc.,
  • McCourt Construction Co. Inc.,
  • Obayaski Corp., and
  • McCourt/Obayaski.

The railings, and the attached concrete barriers, were installed to protect workers walking along the sides of the tunnel, but have since been involved in a series of fatal Big Dig accidents, one involving a state trooper on a motorcycle. The trooper’s widow won a $9 million settlement last fall from the state and the same Big Dig contractors being sued by Hicks.

Edgartown Woman Injured in Single Car Accident

Kaylan Gray, 26, of Edgartown was seriously injured in an unusual single-car accident on Martha’s Vineyard on Monday.

According to the authorities, the crash occurred on the Edgartown-Vineyard Haven Road (across from the regional high school) just after 1 pm.

Police said Gray was operating a 2004 Chevrolet Cobalt when she attempted to pass several cars on the right hand shoulder of the road, when she took down two signs before crashing into a tree at the entrance to Martha’s Vineyard Community Services.

Gray also grazed a pickup truck exiting the Community Services. The pickup truck driver was uninjured, police said.

Gray sustained serious injuries and was airlifted to Massachusetts General Hospital in Boston  by a Medflight helicopter.

According to witness statements, Gray’s vehicle was going at 40-50 miles per hour at the time of the accident.

The two signs she took down were for a speed limit and a 20 mph flashing school zone.

Police are still investigating the crash, but they have ruled out drugs and alcohol as contributing factors in this accident.

Single Vehicle Accidents
According to reports by the National Highway Traffic Safety Administration (NHTSA), 18,745 vehicles were involved in fatal single vehicle crashes in 2009.

Liability Issues and Seeking Legal Help
Since drugs or alcohol do not appear to be factors in the crash, if the investigators in this case find that dangerous road conditions were the cause behind this single vehicle accident, the city or government agency operating the roadway could be held liable.

Dover Man in Serious Car Accident

Alexander Paganelli, 21, of Dover, was found in his wrecked Subaru last Thursday morning by his sister near their home on Miller Hill Road. Paganelli’s sister had just left home around 7:00am when she recognized her brother’s car, crashed against a tree.  Police have reported that it is not known when the collision occurred and how long Paganelli had been there.

Paganelli underwent brain surgery last Friday at a Boston hospital for internal injuries he sustained from the collision.

Police stated that drugs or alcohol have not been named as contributing factors in the serious crash.

Airbag Saves Life of Choking Falmouth Driver

Last Monday afternoon, 53-year-old oil tank repairman Richard Silvia didn’t think much about snacking on raisins while he was driving along Route 28 in Falmouth—until he couldn’t breathe. Silvia, of East Falmouth, lost consciousness after choking on a yogurt-covered raisin, causing him to sideswipe two other cars in the opposite lane of travel. His work truck came to a final stop on an embankment.

The impact set off Silvia’s airbag and the force of the airbag on Silvia caused the raisin to dislodge and Silvia to then regain consciousness. A chain of events that he is certainly giving thanks for. He told reporters, “I thought I was going to die.” According to his fiancĂ©e, Silvia refuses to eat anything unless someone else is near him.

Silvia sustained a cut on his wrist from the accident and one of the other drivers is undergoing treatment for back injuries she suffered in the accident.
